Big Dog Marketing provides direct mail marketing services, including list sourcing, custom design, printing, mailing, AI-powered RSVP booking, and campaign tracking. These Terms apply to all interactions with us.

2. Our Role and Limitations

• We act solely as a marketing service provider. We do not provide insurance, legal, financial, or regulatory advice.
• We do not guarantee results. Campaign performance (response rates, attendance, leads, or revenue) can vary significantly and is influenced by many factors outside our control, including your follow-up, offer, location, timing, and market conditions.

3. No Warranties

All services are provided on an “AS IS” and “AS AVAILABLE” basis. We make no representations or warranties of any kind, express or implied, regarding the quality, accuracy, reliability, or effectiveness of our services.

4. Limitation of Liability

To the fullest extent permitted by law, Big Dog Marketing, its owners, employees, and agents will not be liable for any:

• Lost profits, lost revenue, or lost business opportunities.
• Indirect, consequential, or punitive damages.
• Our maximum liability to you for any claim shall be limited to the total amount you actually paid us for the specific campaign giving rise to the claim.

5. Your Responsibilities

You are fully responsible for:

• Ensuring all your marketing activities (including the use of materials we provide) comply with applicable laws and regulations, such as Medicare Marketing Guidelines, TCPA, and state insurance rules.
• Reviewing and approving all campaign materials before they are printed or mailed.
• Handling all lead follow-up, sales conversations, and enrollments.

You agree to indemnify, defend, and hold Big Dog Marketing harmless from any claims, losses, fines, or expenses arising from your use of our services or any violation of laws on your part.

6. Compliance

While we make reasonable efforts to create compliant materials, you are ultimately responsible for regulatory compliance. We are not liable for any fines, penalties, or regulatory actions you may face.

7. Payment & Cancellation

All payments are non-refundable unless otherwise stated in a signed agreement. We reserve the right to suspend or cancel services if payments are not made on time.

8. Intellectual Property

Designs and materials we create for you remain our intellectual property until you have paid in full. You receive a limited, non-exclusive license to use the approved materials for your campaign.

9. Changes to These Terms

We may update these Terms from time to time. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Colorado.
