Terms of Service

These Terms govern your use of unleashwithbigdog.com, our event pages, and our client/broker portal (the "Services"). Big Dog Marketing ("Big Dog," "we") is owned by Walker Zivi, 11091 Trojan Ct, Westminster, CO 80031 (marketing@thebigdog.llc). By using the Services, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18. Keep your login details confidential. You are responsible for everything done under your account. Tell us right away if you think your account has been used without permission.

2. Events and RSVPs

Event details, speakers, and seating may change. An RSVP or seat booking does not guarantee admission if an event is over capacity, changed, or cancelled. We may refuse admission to anyone who is disruptive.

3. Payments and refunds

Square processes payments, and Square's terms also apply. Prices are shown at checkout. Unless a listing says otherwise:

Event tickets are fully refundable if you request a refund at least 7 days before the event.
No refunds are given within 7 days of the event, except as stated below.
If we cancel an event, you get a full refund.
Marketing services are billed as stated in your agreement or invoice, and fees already earned are not refundable.

4. Client and broker responsibilities

If you upload contacts or send messages or calls through the portal, you confirm that:

You have every consent the law requires, including prior express written consent for marketing texts and AI or prerecorded-voice calls under the TCPA.
You will follow the TCPA, CAN-SPAM, the CTIA guidelines, Do-Not-Call rules, quiet-hours laws, and state recording/consent laws.
You will honor opt-outs right away.

You agree to indemnify Big Dog for claims arising from your contacts, your content, or your messaging.

5. Acceptable use

You may not:

send spam or messages without consent
upload data you have no right to use
break the law or anyone's rights
impersonate anyone
send harassing, deceptive, or illegal content (including content regulated under SHAFT categories without proper controls)
probe, scrape, overload, or bypass the security of the Services
reverse-engineer the platform

6. Suspension and termination

We may suspend or end your access at any time for a breach, a suspected legal or compliance risk, or nonpayment. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

7. Intellectual property

The Services and our content belong to Big Dog or its licensors. You keep ownership of content you upload, and you grant us a license to use it only to provide the Services.

8. Third-party services

The Services rely on third parties (for example Square, Twilio, ElevenLabs, and Google). We are not responsible for their services.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee leads, attendance, sales, message delivery, or AI accuracy. AI-generated calls, transcripts, and summaries may contain errors.

10. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

BIG DOG IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) $100.

11. Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute must be brought exclusively in the state or federal courts located in Adams County, Colorado, and you consent to their jurisdiction.

12. Changes

We may update these Terms. If you keep using the Services after we post changes, you accept them.
